In the series, Alfonso Ribeiro created a dance that became iconic of his character, which was always reproduced to the sound of the song "It's Not Unusual", by American singer Tom Jones. The actor is well known for his dancing and often uses it on TV shows in the US. In the process, Ribeiro says he was in the middle of the process to register the copyright for the dance.

The lawsuit documents, which were obtained by TMZ, show that Alfonso Ribeiro says the "Fresh" dance, which has been available in the game since January 2018, is a copy of his dance, and requires redress.

"It is widely recognized that Mr. Ribeiro's appearance and intellectual property was misappropriated by Epic Games in the world's most popular video game, Fortnite. Epic made record profits thanks to downloadable in-game content, including dances like 'Fresh '. However, Epic did not compensate Mr. Ribeiro or ask for his permission to use his likeness or his iconic intellectual property," says the actor's attorney in the lawsuit.
